We publish data relating to crime statistics from two main sources: The Crime Survey for England and Wales and crime recorded by the police. The magistrates' court defendant case level dataset is owned by the Ministry of Justice (MoJ) and we only make this available through Data First on the Office for National Statistics Secure Research Service (SRS). For the purposes of the Freedom of Information Act (FOIA) 2000, if a public authority holds the information solely on behalf of another person, the information is considered to be not held. This is outlined under section 3(2)(a) of the Act.
